COMPLAINTS PROCEDURE

1. General provisions
The complaints procedure is issued in accordance with the provisions of Act no. 40/1964 Coll. and so on of the Civil Code. This complaint procedure regulates the conditions and methodclaims for goods that are within the warranty period and sold by VISIMPEX spol. s.r.o.
- The buyer, who can be an entrepreneur or a consumer, is obliged to familiarize himself with the Complaints Procedure and the General Terms and Conditions
- By concluding the purchase contract and taking over the goods from the seller, the buyer agrees to this complaint procedure.
- Taking over the goods means signing the delivery note or handover protocol from the transport company.
- As proof of warranty /warranty certificate/, the seller issues a purchase document /invoice, cashier's receipt - hereinafter referred to as warranty certificate/ with all the necessary data in accordance with the law for the application of the guarantee /in particular product name, quantity, price/ for each purchased item.
2. Warranties and warranty period
The warranty period begins on the day of receipt of the goods by the buyer. The seller provides a 24-month warranty for the sold goods in the sense of the applicable legal regulations, unless otherwise stated. The warranty applies to:
-defects in the goods that become apparent during the warranty period /qualitative defects/,
- errors in the delivery of goods /damaged transport packaging, incorrect quantity, other goods, etc./.
The warranty does not cover defects caused by:
- improper use or storage of goods,
- if the fault was not claimed within the warranty period,
- natural or excessive wear and tear,
-using the wrong tools and accessories during assembly,
- mechanical or chemical damage to the goods,
- in the case of modifications that change the original properties or parameters of the goods / change in surface finish, size, strength, etc./
The warranty also does not cover damage caused by natural events. For goods whose usability is limited by the use-by date, a guarantee for functionality and properties is provided only if it has been used until this time.
3. Claim application
- The buyer /consumer/ has the right to complain about the delivered goods purchased from the seller as soon as he discovers any errors and defects in the goods.
- The buyer is obliged to check the status of the shipment with the carrier immediately upon delivery of the goods. He is entitled to refuse to accept the shipment if it is not in accordance with the purchase contract, or is incomplete or damaged.
a) The buyer can make a claim:
- in person at the store in the seller's business / Areál Agropodnik a.s. Trnava, Trenčianske Bohuslavice/, while the seller writes a complaint letter on the spot.
- in written form in the complaint protocol sent by post, fax or e-mail, in which the buyer states the reason for the complaint and a precise description of the complained defect.
The complaint protocol is listed on the website of VISIMPEX spol. Ltd.
Confirmation of the written complaint is sent by the seller to the buyer in turn. When making a claim, the buyer is obliged to present the claimed goods /if it is a claim for a defect in the goods/, proof of purchase of the goods /invoice, cash register/. Complaints and their authorization are assessed by the seller and processed in accordance with applicable legislation and without unnecessary delay. In case it is not possible to assess and process the claim immediately, the seller will notify the buyer in writing of the deadline for processing the claim, no later than within 30 days of the application of the claim. b) The buyer has the right to reimbursement of necessary costs /especially the postage that he paid when sending the claimed goods/, which he incurred in due to the exercise of his rights from liability for errors and were actually and purposefully spent.
Goods sent for a claim or returned by the customer cannot be sent cash on delivery.
The buyer can return goods that are not the subject of a complaint after agreement with the seller. These goods can be returned no later than 30 days after they have been received by the buyer and only with the prior consent of the seller. It must be goods that were demonstrably purchased from VISIMPEX spol. s.r.o.. and must be in its original condition and in undamaged packaging. It must be a standard stock item and not an item that has been ordered exclusively for the buyer. The cancellation fee is 20% of the purchase price. Consumer packaging is packed with a tolerance of +/- 3%. Deviations in the number of pieces within this tolerance will not be considered as a valid claim.
4. Final provisions
This complaint procedure has been valid from March 4, 2016, it cancels the validFinality of previous complaint procedures and remains valid until a new or updatedmplaint procedure is issued.
